Every American deserves the dignity to live independently in a safe environment. Today, there are more than 40 million people with disabilities in the United States, and as the population ages, that number is projected to grow dramatically. There are currently more than 10 million blind or visually impaired people in the U.S., with someone new becoming blind or visually impaired every seven minutes.

One of the most sweeping federal civil-rights laws ever passed is the Americans with Disabilities Act of 1990. The ADA ensures that public domains in the United States are safe and accessible to everyone, regardless of health or handicap.

To provide a safer environment for visually impaired citizens on public streets and sidewalks, the Americans with Disabilities Act Accessibility Guidelines (ADAAG) mandate the use of detectable warnings on curb ramps, hazardous vehicular areas, and transit platforms. By rule, detectable warnings consist of raised truncated domes with a diameter of 0.9", a height of nominal 0.2", and center-to-center spacing of nominal 2.35". All Alert Tile® products meet or exceed ADAAG and state DOT requirements.

Under the Americans with Disabilities Act, all public facilities — including hotels, motels, and shopping centers constructed after January 29, 1993 — must be accessible to and usable by persons with disabilities. In addition, existing facilities must undertake readily achievable barrier removal to comply with the Act. GBR Paving has developed deep expertise in exterior ADA concrete and asphalt work, and we complete all work per plans and authorized engineers or architects.

Grade Work — 2% Maximum Slope

This involves removing and replacing concrete or asphalt and re-grading the surface so that it meets the 2% maximum slope required for ADA compliance. Many existing pathways are too steep for people with disabilities, and bringing them into compliance is one of the most common — and most cited — remediation needs on commercial property.

We install all necessary signs and street markings required under the ADA. Path of Travel: we construct pathways that allow ADA access to all areas of a property, including off-street access. Truncated Domes: we install cane detection under outside staircases to prevent blind pedestrians from walking into the staircase, and detectable warnings on ramps to notify of a road crossing. Handrails: fabrication and installation to ADA specifications.

IF YOU BECOME A DEFENDANT IN A LAWSUIT THAT INCLUDES A CLAIM CONCERNING A SITE INSPECTED BY A CERTIFIED ACCESS SPECIALIST, YOU MAY BE ENTITLED TO A STAY (TEMPORARY STOPPAGE) OF THE CLAIM AND AN EARLY EVALUATION CONFERENCE. ADA Compliance

Inspections & Services

Many properties are not compliant with the Americans with Disabilities Act (ADA), although they are supposed to be. Title III of the ADA states that all "Public Accommodation and Commercial Facilities" must perform barrier removal. Nearly 1 in 5 people have some sort of disability, and making your property accessible is the law. If your property is not compliant, you may be a target of a lawsuit.

As an owner or tenant, you are entitled to benefits under Senate Bill 1608 in the State of California if you evaluate your property by a Certified Access Specialist (CASp) and set in place a "Transition Plan" for barrier removal.

CASp Evaluation & Reports

GBR Paving – CAS (Certified Accessibility Solutions) can inspect your property for accessibility compliance and issue a CASp report under the ADA and Title 24 of the California Code of Regulations (2010 CBC), with benefits under CA Senate Bill 1608.

Surveying & Design

We survey and design parking, curb ramps, pedestrian ramps, accessible routes, restrooms, and architectural design elements your property may need to meet accessibility compliance.

Consulting Services

As a Certified Access Specialist, we consult on any accessibility issue — researching questions under the ADA, Title 24 (CBC 2010), the Fair Housing Act, HUD, and the ABA. Includes contractor consultation, agency letters, report rebuttal, depositions, and expert witness services.

Construction Coordination

We coordinate every aspect of bringing your property into compliance — acquiring permits, locating qualified contractors, and managing the project from inspection through certification.

Budgetary Planning

We help put a 'Transition Plan' in place for 'Barrier Removal' and budget planning to comply with ADA laws. We can also help determine if an 'Unreasonable Hardship' or 'Practical Difficulty' applies and draft a letter for the governing agency or appeals board.

CASp Certificate of Inspection

Upon completion of the evaluation report, we issue a 'Certificate of Inspection' in accordance with CA Senate Bill 1608. The Certificate can be posted in your window to identify the property as 'CASp Inspected' or 'CASp Determination Pending.'

Business Tax Incentives

The Federal government offers two tax incentives to help cover the cost of making your business accessible to persons with disabilities. Consult with your tax accountant to take advantage of them. A business that annually incurs expenses to bring itself into compliance with the ADA may use these incentives every year. They may be applied to a variety of expenditures — but not to the costs of new construction — and all barrier removal must comply with applicable Federal accessibility standards.

IRS Section 44

Tax Credit

Small businesses with 30 or fewer employees or total revenue of $1 million or less can use the Disabled Access Credit. Eligible small businesses may take a credit of up to $5,000 (half of eligible expenses up to $10,250, with no credit for the first $250) to offset costs for access — including barrier removal, accessibility services (e.g., sign-language interpreters), printed material in alternate formats (large-print, audio, Braille), and equipment provision or modification.

Tax Deduction

Businesses of all sizes may take advantage of this tax deduction. Businesses can take a business-expense deduction of up to $15,000 per year for costs of removing barriers in facilities or vehicles.

Tax Incentives in Combination

These two incentives can be used together by eligible businesses if the expenditures qualify under both Sections 44 and 190. If a small business' expenses exceed $10,250 for the maximum $5,000 tax credit, then the deduction equals the difference between the total spent and the amount of the credit claimed.
